ADHINIYAM 2002
First of its kind in the country for ensuring improvement of quality in
Government Schools (elementary) through sharing of responsibility.
Universalisation of elementary education is a collective endeavor of government
and society. The Jan Shiksha Adhiniyam helps to move forward in this direction.
The Act ensures quality education available for all children of Madhya Pradesh.
RIGHTS OF LEARNERS
Every Child in Madhya Pradesh has a right to access elementary education of
quality.

Learners, if they are more than 25 in the tribal areas and 40 in non-tribal
areas, have the right to have a primary schooling facility within 1 km of their
habitation.

No child shall be denied admission for elementary education in Government and
Local body schools.
If any person prevents a child from accessing education, he or she is punishable
Under Section, 4(2).

Under Section 22 of the Act, the Gram Sabha can impose fine on a parent, who is
willfully not sending the child to School.
-
The learners have the right to good quality education, this right will be
realised through the enhanced commitment of the teachers, academic and
managerial support from the government and active involvement of parents.

No
tuition fee shall be collected from any child studying in any Government and
Local body school of the state under Section, 6(1).

Based on the local requirements, school timings and local holidays shall
be decided by Parent Teacher Association to facilitate the right to education of
children, specially of deprived communities and girls. The Act provides regular
monitoring of quality education in schools by Parent Teacher Association.
RIGHTS AND RESPONSIBILITIES OF TEACHERS
Teachers have
both rights and responsibilities under the Jan Shiksha Adhiniyam. So far, the
teachers were alone in the endeavor of ensuring good education. Now they would
have the support of Community and Parents through Parent-Teachers Association in
each school.

Teachers cannot be deputed for non-teaching tasks except with
explicit orders of Government from State level (under Section 10). This will
provide more time to focus on improving quality of education. Teachers have
right for their Professional development [Under Section 25(4) ].
Incentives would be given for meritorious teachers.

Teachers will ensure regular attendance of children in the school.
-
Punishment of children in any form is banned.
Teachers will:
-
Provide quality and remedial teaching to ensure achievement of children up to a
satisfactory level.

Ensure equitable treatment to all children.
-
Present and review the Annual Academic Report (Jan Shiksha Prateevedan) to
Parent Teacher Association to ensure transparency.
-
Organise PTA meetings every month to consult and review the academic achievement
of children and other problems of school.
RIGHTS AND RESPONSIBILITIES OF PARENTS
The Act provides learning facility as per norm, now it is parents responsibility
to ensure all children enrolled in school.
Parents have
the right:
-
To form Parent Teacher Association and elect President, Vice President and
Executive Committee.

To identify suitable persons like retired teachers to contribute their time to
teaching in Schools on an honorary basis and enlist them through PTA.
-
To see answer sheets of their children in meetings of Parent Teacher Association
and to take action to improve situation of weaker children.
-
To admit their children in schools in mid-session, in case they migrate to
different destinations in course of the year.
-
To
augment the resources of school through Shala Shiksha Kosh.
-
Management of School is the responsibility of Parent Teacher Association.
-
Learning Achievement of Children would be reported to PTA in every quarter
[under Section 25(3)]
RIGHTS AND RESPONSIBILITIES OF ELECTED REPRESENTATIVES
Management of school and ensuring quality has been brought under the supervision
of People’s representatives, at school level through PTA, at village level
through Gram Sabha, at District level through Zilla Panchayat, Municipal Bodies
and Zila Yojana Samiti.

Jan Shiksha Yojna developed by PTA shall be presented to Gram Sabha at village
level and to Zila Yojana Samiti at district level for discussion and approval.
-
Provision has been made for discussion of academic reports at the school level
in the meetings of PTA, which is a legal entity.
-
Provision made for discussion & review of academic records of children on annual
basis, through, Annual Academic Report prepared on the basis of Legislative
Constituencies and would be placed in the District Planning Committee each year.
-
State level Annual Academic Report, giving constituency-wise information on
academic status of preceding academic session is to be presented in the winter
session of the Assembly each year.

Performance of teachers to be monitored by the elected representatives through
Parent Teacher Association of each school.
JAN SHIKSHA KENDRA
A middle school designated as Jan Shiksha Kendra for a cluster of primary &
middle schools to act as quality circle to provide:

Mutual
academic support to teachers

Opportunities
for exchange of experiences

Support
schools academically
-
Head master of concerned school will be Jan Shiksha Prabhari
-
A Jan Shikshak will be designated to coordinate between schools and Jan Shiksha
Kendra
JAN SHIKSHAK
Jan Shikshak has to be:
-
Upper Division Teacher/Shiksha Karmi grade -2 or 3 (regular)
-
D.Ed./B.Ed
trained
-
Below 50 years
in age
-
5 year of teaching experience in school.
Jan Shikshak shall:
-
Provide
academic support to teachers of primary level
-
Provide on the
spot guidance to teachers at the time of school visit
-
Coordinate
training programme of teachers
-
Coordinate
between school & community
-
Review status
of educational indicators viz. enrolment, attendance, retention & achievement
JANPAD SHIKSHA KENDRA
Establishment of Janpad Shiksha Kendra at block level to coordinate activities
of elementary education.
There shall be a Janpad Shiksha Kendra coordinator and 3 Janpad Academic
Coordinators to provide academic support to schools and Jan Shiksha Kendras.
ZILA
SHIKSHA KENDRA
Zila Shiksha Kendra shall consist of:

District Project Office of Shiksha Mission.
Zila Shiksha Kendra shall coordinate, supervise and support activities of
elementary education and total literacy at district level.
RAJYA SHIKSHA KENDRA (RSK)

Rajya Shiksha Kendra shall merge within it SCERT, Directorate of Adult Education
& other project units for elementary education.
-
RSK will be responsible for planning, budgeting, monitoring and academic &
financial management of elementary education and total literacy in the State.
-
Account of Rajya Shiksha Kendra will be operated by joint signatures of the
Commissioner, RSK and Drawing & Disbursing Officer of RSK.
SHIKSHA KOSH
Shiksha Kosh to be established at school, district and state level for resource
mobilisation.
-
Shala Shiksha Kosh shall be utilised under the overall supervision and control
of Parent Teacher Association.
-
Fund mobilised shall be utilised for enhancing educational facilities for
school.
-
Account of Shala Shiksha Kosh
to be operated jointly by President and
Secretary(teacher) of Parent Teacher Association.
ZILA SHIKSHA KOSH
Fund mobilised will be utilised for promotion of cause of education in the
district and state respectively.
JAN SHIKSHA YOJNA (JSY)
-
PTA to prepare Jan Shiksha Yojana of the habitation to be approved by Gram Sabha.
-
Zila Shiksha Yojana shall be submitted to Zila Yojana Samiti for approval.
-
Rajya Shiksha Yojana prepared by Rajya Shiksha Kendra shall be submitted to the
State Government.
-
Progress of implementation of all Shiksha Yojanas shall be monitored at each
level.
